Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CabaretMetrics website and platform located at https://cabaretmetrics.com (“CabaretMetrics,” “CM,” “we,” “our,” or “us”). By accessing, registering for, or using CabaretMetrics in any manner, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the platform.

Eligibility

You must be at least eighteen (18) years of age to use CabaretMetrics. By using the platform, you represent and warrant that you are legally permitted to enter into this agreement and that all information you provide is accurate.

Platform Role and Disclaimer

CabaretMetrics is a technology platform only. We do not own, operate, manage, control, or supervise any physical club, venue, or business. We do not employ dancers, staff, or contractors of any club.

CabaretMetrics does not verify the accuracy, legality, or appropriateness of user-submitted content and does not guarantee business outcomes, earnings, traffic, or performance.

User Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or security breach.

CabaretMetrics is not responsible for losses resulting from unauthorized account use caused by user negligence.

User-Generated Content

CabaretMetrics allows users, including dancers and clubs, to upload content such as photos, images, profile information, and related media (“User Content”). You retain ownership of your content.

By uploading content, you grant CabaretMetrics a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and distribute the content solely for operating and promoting the platform.

Content Responsibility and Prohibited Material

You are solely responsible for all content you upload. CabaretMetrics does not pre-screen content and assumes no responsibility for user submissions.

Prohibited content includes, but is not limited to:

Content involving minors or individuals under 18
Non-consensual or exploitative material
Illegal, obscene, or unlawful content
Copyrighted material without proper rights
Harassment, threats, or hate-based content
False or misleading representations

CabaretMetrics reserves the right, but not the obligation, to remove content at its sole discretion.

No Liability for User Content

CabaretMetrics expressly disclaims all liability arising from user-generated content. Users agree that CabaretMetrics is not responsible for reviewing, approving, monitoring, or policing uploaded content.

You acknowledge that content uploaded by users may be offensive, explicit, or inappropriate and agree that your use of the platform is at your own risk.

Reporting Violations

Users may report content believed to violate these Terms by contacting Cabaretmetrics@outlook.com. CabaretMetrics may investigate and take action but is not obligated to do so.

Subscriptions and Payments

Access to certain features requires a paid subscription. All subscription payments are auto-billed and are non-refundable except where required by law or explicitly stated otherwise.

Subscription terms, renewals, and cancellations are governed by the CabaretMetrics Subscription Policy.

Acceptable Use

You agree not to misuse the platform. Prohibited activities include attempting unauthorized access, interfering with system functionality, submitting false data, scraping, reverse engineering, or using the platform for unlawful purposes.

Third-Party Services

CabaretMetrics may integrate with third-party services such as payment processors. We are not responsible for third-party systems, outages, errors, or data handling.

Service Availability

The platform is provided “as is” and “as available.” CabaretMetrics does not guarantee uninterrupted service and may perform maintenance or updates at any time.

Right to Suspend or Terminate Services

Cabaret Metrics reserves the right to suspend or terminate services at any time, with or without notice, if we determine, in our sole discretion, that a club:

Violates this policy or any related Cabaret Metrics policy
Misuses, abuses, or attempts to manipulate the platform
Uses the platform in an unlawful, deceptive, or harmful manner
Engages in fraudulent activity, chargebacks, or payment disputes
Attempts to copy, reverse engineer, replicate, or exploit proprietary systems

In the event of termination due to violation or misuse:

Services may be immediately suspended
Access to the website and platform may be disabled
All outstanding balances may become immediately due
No refunds will be issued

Cabaret Metrics is not liable for business interruption, loss of revenue, or damages resulting from termination under this section.

Disclaimer of Warranties

To the fullest extent permitted by law, CabaretMetrics disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

Limitation of Liability

CabaretMetrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, even if advised of the possibility of such damages.

Total liability shall not exceed the amount paid to CabaretMetrics in the previous twelve (12) months.

Indemnification

You agree to indemnify and hold harmless CabaretMetrics, its owners, affiliates, and partners from any claims, damages, liabilities, costs, or expenses arising from your use of the platform, content you upload, or violation of these Terms.

Termination

CabaretMetrics may suspend or terminate access at any time for violations of these Terms, non-payment, or conduct that may harm the platform or other users.

Governing Law and Venue

These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved exclusively in the courts located in Phoenix, Arizona.

Changes to These Terms

CabaretMetrics reserves the right to update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
